Do I deal this through a lawsuit? | #1 | |
Me and my "sister" have been in each other throats for all of my life but this is the straw the broke the camel's back.
So I got back from my 21st b-day party. I get a text from my "sister" (I put them in quotes for a reason) asking where are my bows I asked them why and she said because she is going to take them and sell them to someone else so she can pay her own bills I fought with her via text saying that she cannot sell my stuff (she has done this multiple times). And she made this story that my mom was intended to sell it in the first place without me knowing. So I finally called mom and she said that she can use my bow but not to sell it which is my "sister's" intentions. So basically she has made this whole lie about my mom wanting to sell it, but if my mom wanted to sell it she would of told me in the first place before the act occurred. So now my "sister" is calling me childish because I have a hold to a special Item that made me special that I have archery as a sport. But does being childish is selling someones stuff so she can pay her own bills. My mom talked to her to not sell it, but she isn't listening to her multiple times. My mom will come back on Monday I have text messages to prove that she has lied to me and my mom and has intentions to sell my stuff, and on top of that she told me that my mom "gave" her my bows over a month ago which is a total lie. So all in all what do I do is my sold my bow, I know I want to sue her for theft, but is there any advice proceeding it.

well if she hasn't sold the bows you have no case and if she does you can only get a case if you can prove the bows are worth something and that they are your and yours alone, though all you'd get is money, not your stuff back

Sueing her would cost a heck of a lot more than $500, so it might not be worth it. You could report her for theft if she does go through with it I imagine, but it wouldn't guarantee you got them back. At least as far as I'm guessing. I'm only really aware of the Canadian legal system and that probably won't help.
Your best option I think is to not let her sell them in the first place. If you live away from her, maybe have them shipped to you? It will cost more money, but it might be worth it for peace of mind. | ||||

and I am keeping all for my texts from her so that way if there is any evidence of lie and theft I got it and the only thing I could do is file a police report and if they find it, she will be arrest on either felony charges or have fines to pay

I hope you get your bow back and teach your sister a lesson on stealing. I bet she wanted it for something else then "Paying the bills" if you know what I mean.
My parents are going to see a lawyer this week because of the car wreak we were in a few weeks back. Long story short the ambulance people treated my parents poorly. | ||||

First if I were you I'd hide my bows, i would
move things to an area that is either constently under your supervision or in a place that she is not going to find it - or if she does she has to come by you with the bows. the items belong to you, even if she is family if you are above age 18 and an adult she cannot just take your stuff. no. doesn't work that way. a lawsuit is going to cost much more than the worth of the bows, so i'd stay away from that. but you can report her for theft as well as telling your mum what's going on and how you intend to stop it. let her know, firmly that you intend to report her if she just up and takes your stuff. also let her know that she needs to find another way to pay her bills or ask for help. if she needs help paying, she should ask not take. explain it to her calmly and rationally and if she still acts badly take further action. but don't bring it to a lawsuit it will cost way more than it's worth. however if you do have a lawyer friend, you can get them to write a friendly but threatening letter to her. if she doesn't know you don't intend to carry out a lawsuit, that may stop her. good luck. bitches please

My sister is older than me she's 22, so far all my mom is saying is that she going to deal with it. But I got a feeling that it isn't going to work. I told my mom that I can go as far as report her to the police for theft and my mom said no don't do that. But I intend to because it is the right thing to do and she needs to be in place. Everyone lets her get away with murder and I'm not going to let that happen.
Thanks daring. And I'm a pawn broker and I Have times when people brought in stolen items. And I have evidence of her lies. And this isn't her first time doing this she has done this before multiple times and my mom lets her get away with it. But this time I'm taking it to account | ||||

The advice about the $500 not being enough money to sue over is wrong. It's not enough to get a lawyer and a big court case, but small claims court exists specifically for numbers that small -- depending on jurisdiction $100 may even be enough for small claims court. You just don't have the whole rigamarole of lawyers or anything; you just present your case to the judge, and the judge decides what happens.
